Caterpillar Agrees to Settle a Class Action Lawsuit

On Friday, July 1st, Caterpillar, a well-known maker of heavy duty equipment has just reached a tentative settlement to resolve a class action lawsuit involving their engines with an exhaust emission control system, otherwise known as the Cat Regeneration System.

The reason for the initial lawsuit was that Caterpillar customers claimed that the systems caused highway diesel engines to lose horsepower and shut down.   Subsequently, the trucks then were towed to a Caterpillar – authorized repair facilities for repairs. However, here was the catch, most of the repairs involved computer codes and special software that only qualified technicians could handle. Unfortunately, for many consumers, the repairs were done by technicians who could not effectively do such repairs.

Youth Soccer Associations File Class Action Suit To Collect Fees From Pros

On Friday, July 1st, a class action lawsuit was filed in a Texas Federal Court by three youth soccer clubs (Dallas Texans, Crossfire Premiere of Redmond, Washington and Sockers of Chicago). The lawsuit was filed against the MLS Players Union and world renowned soccer starts, DeAndre Yedlin, Michael Bradley, and Clint Dempsey. The reason for the lawsuit is that this is an attempt to recoup hundreds of thousands of dollars in training and solidarity fees.

Ticketmaster Settles $386 Million Class Action Lawsuit

The 13-year class action battle against popular ticket vendor website, Ticketmaster, has reached a settlement. The dispute revolved around the lack of clarity in Ticketmaster’s description of their service fees. The two individuals who filed the lawsuit jointly in 2003 claimed that Ticketmaster’s fees were both “excessive and misleading.”

Customers Join Class Action Lawsuit Against Dollar General Over Oil

In early June of this year, customers of Dollar General joined together to file a class action lawsuit again Dollar General.   Dollar General is accused of deceptive marketing practices when selling certain kinds of motor oil that cannot be used in cars built after 1930.  In addition, they are also being sued for practices on motor oil that cannot be used in cars after 1988.

Genentech and OSI Pharmaceuticals to Pay $67M

Genentech and OSI Pharmaceuticals will pay $67 million as part of a federal court settlement over misleading claims about the drug Tarceva which was approved to treat non-small-cell lung cancer and advanced stage pancreatic cancer.

Between January 2006 and December 2011, both companies led doctors to believe that Tarceva would work in a broad patient population when it was intended to be used on a narrower patient population that included patients who had never smoked and people who carried a particular mutation in a protein that is involved in the spread and growth of cancer cells.
