Young Tourist Sues NYC after Losing Her Leg

Sian Green, 24 was on vacation with her best friend in New York City, enjoying  a hotdog near Rockefeller Center when a cab driver jumped the curb and struck her. The young woman lost her leg as a result of the accident and is now suing the city for 27.5 million dollars. According to reports the cab driver, Faysal Himon should not have even been driving at the time of accident, as his license should have been suspended for previous violations before the accident. The taxi and limousine commission admittedly failed to suspend Himon, due to a “computer glitch”.

 

The victims lawyer Dan Marchese says Green will claim that the cabbie at the wheel in the Aug. 20 crash on Sixth Ave. didn’t belong on the road because of his reckless driving record. It is reported that the cabby Faysal Himon had seven points on his licence  for motor vehicle violations on the day of the accident, which is enough to trigger an automatic suspension of his license. The TLS admits they failed to keep pedestrians safe as a direct result of the computer glitch. “The Taxi & Limousine Commission should have suspended his license before the time of the accident,” Marchese wrote in the notice of an impending lawsuit.

In November it was announced that no criminal charges would be brought against cab driver, Faysai Himon. Greens attorney, Dan Marchese states; “while she is incredibly dismayed by this decision, she does not let it affect her positive spirit, unbelievable strength and incredible poise”. Green, an aspiring model and fashion buyer, says she will not let this “ horrific incident destroy her dreams”. Marchese will insist that the accident was a direct result of negligence and calculated recklessness. Himon maintains that the accident is not his fault, stating that he lost control of the car after a cyclist slammed the hood of his vehicle. He is believed to have gotten into an argument with cyclist Kenneth Olivo just seconds before the crash.“The only thing I really wanted to do was go to the top of the Empire State Building” says Green who was in NYC to visit friends, shop and see the sights. She  has been pictured with friends at  work events and parties holding her walker and maintaining a positive attitude as she attempts to move forward.
