{"id":8323,"date":"2020-05-27T11:48:53","date_gmt":"2020-05-27T15:48:53","guid":{"rendered":"https:\/\/blog.lawyer.com\/?p=8323"},"modified":"2020-05-27T11:48:53","modified_gmt":"2020-05-27T15:48:53","slug":"when-there-is-smoke","status":"publish","type":"post","link":"https:\/\/blog.lawyer.com\/index.php\/when-there-is-smoke\/","title":{"rendered":"When There is Smoke&#8230;"},"content":{"rendered":"<figure id=\"attachment_8324\" aria-describedby=\"caption-attachment-8324\" style=\"width: 300px\" class=\"wp-caption alignright\"><a href=\"https:\/\/blog.lawyer.com\/wp-content\/uploads\/2020\/05\/grill.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-8324\" src=\"https:\/\/blog.lawyer.com\/wp-content\/uploads\/2020\/05\/grill-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/blog.lawyer.com\/wp-content\/uploads\/2020\/05\/grill-300x200.jpg 300w, https:\/\/blog.lawyer.com\/wp-content\/uploads\/2020\/05\/grill-768x512.jpg 768w, https:\/\/blog.lawyer.com\/wp-content\/uploads\/2020\/05\/grill-1024x683.jpg 1024w, https:\/\/blog.lawyer.com\/wp-content\/uploads\/2020\/05\/grill-450x300.jpg 450w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><figcaption id=\"caption-attachment-8324\" class=\"wp-caption-text\">There is fire<\/figcaption><\/figure>\n<p>Alleging false advertising, two consumers of Traeger grills are accusing the company of selling wood pellets that are not in accordance with the \u201cAll Natural Hardwood\u201d claim on the product label.\u00a0 Small traces of food-grade soybean oil are added to the pellets to provide enhanced flavor and grease.\u00a0 The plaintiffs, Michael Yates and Norman Jones, argue that only 1\/3 of the wood is comprised as advertised, leading them to pay above market value price for the pellets that are, according to their dispute, not entirely natural.<!--more--><\/p>\n<p>The purpose of a Traeger wood pellet grill is to develop smoke rather than placing food over a direct flame.\u00a0 The company contends that their business methods and product supplies have remained <a href=\"https:\/\/www.sltrib.com\/news\/2020\/05\/26\/lawsuit-dismissed-against\/\">consistent<\/a> for the past sixteen years.\u00a0The original owner of the Traeger grill, established in 1986, sold the company in 2006, and the company was sold again in 2014. \u00a0Although the company sells 14 different types of wood for the pellets, some of the flavors in question include hickory, apple, mesquite, pecan, and cherry.\u00a0 Synthetic flavors are included to endorse any potentially muted aromas.<\/p>\n<p>This action is what Yates and Jones may consider deceptive business practices.\u00a0 Given the presentation that consumers are purchasing an all-natural product, they may be willing to pay the mark up in value.\u00a0 However, contemplating the recent discovery that the pellets are enhanced with oils, the value of the pellets purchased arguably decreases.\u00a0 Despite the filing of this claim as a class action lawsuit, a Utah district court judge failed to see the qualification of this case as a class action.
