In the film, the pirates transform into living skeletons under moonlight. This author failed at attempting to make billions when a federal judge ruled in Disney&#8217;s favor. Royce Matthew, the plaintiff in this suit, has failed several times in lawsuits regarding the wildly successful\u00a0<i>Pirates of the Caribbean<\/i>\u00a0films.\u00a0His first lawsuit attempt dates back to 2005, promptly followed by a second attempt in 2006. The 2006 lawsuit was quelled when Disney revealed old &#8220;theme park art&#8221; that dated far beyond Royce Matthew&#8217;s claims. This art proved that Disney independently put forth the idea of &#8220;unique supernatural elements&#8221;. After this event, Matthew signed a release form.<\/p>\n<p><!--more Read More--><\/p>\n<div>\n<p>As Disney continued to publish more of this art with modifications that were attributed to a variety of artists. This generated suspicion for Royce Matthew and he began a third lawsuit in 2013. He claimed that Disney had &#8220;altered and tampered&#8221; with the artwork for the purpose of creating the illusion that they had created the idea on their own.<\/p>\n<p>U.S. District Judge\u00a0<strong>R. Gary Klausner<\/strong>\u00a0firmly ruled that Mathew cannot assert any copyright claims, until he properly alleged notice of rescission on that release he signed at the end of the second lawsuit. &#8220;Defendants have never maintained that laches is a complete bar to Plaintiff\u2019s copyright infringement claims,&#8221; writes Klausner in an opinion that granted Disney&#8217;s motion to dismiss without any opportunity for Mathew to amend his claims. &#8220;Defendants argue, and continue to argue that the Release bars Plaintiff\u2019s claims, and that if Plaintiff wants to pursue his copyright claims, he must first properly allege a rescission claim.&#8221;<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>In a shocking lawsuit, an author claimed that Disney stole his idea in their film,\u00a0Pirates of the Caribbean.
